More restaurants are adding lines labeled "Service Fee", "Kitchen Living Wage", or "Automatic Gratuity". Are these legally identical to tips?

Voluntary Gratuity

Under US labor law (Fair Labor Standards Act), a tip belongs 100% to the employee. Managers and owners are legally forbidden from taking any portion of tips.

Mandatory Service Charge

A service charge belongs legally to the restaurant business, not the server. The employer has full discretion over whether to distribute it to the waitstaff, share it with cooks, or keep it for business overhead. Always check your receipt to verify if gratuity was already included!
